By accessing or using the Direct HVAC Leads website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Services
Direct HVAC Leads provides lead generation services for HVAC contractors, including:
- Development and hosting of geo-targeted websites
- Search engine optimization for local HVAC searches
- Exclusive territory-based lead delivery
- Satellite website networks
- Ongoing website maintenance and optimization
Territory Exclusivity
When you subscribe to a territory, you receive exclusive rights to leads generated within that geographic area for the duration of your active subscription. Exclusivity is maintained as long as your account is in good standing and payments are current.
Payment Terms - All Services Are Prepaid
All payments are required in advance. We operate on a 100% prepaid model for the following reasons:
- Immediate Resource Allocation: The moment you sign up, we begin dedicating development resources, server infrastructure, and SEO efforts to your territory. Prepayment ensures we can commit fully from day one.
- Serious Contractors Only: Prepayment ensures we work with committed business owners who are serious about growing their HVAC business, not tire-kickers.
- Upfront Investment: We invest significant time and resources building your hand-coded website network before you receive your first lead. Your prepayment covers this upfront work.
- No Billing Disputes: Prepayment eliminates collection issues and allows us to focus 100% on generating leads for you, not chasing invoices.

Payment Schedule
- Setup Fee ($650): Due in full before any work begins on your territory
- Weekly Fee: Prepaid weekly in advance. Your first week is due before your sites go live.
- Renewal: Weekly fees are due at the start of each service week
- Payment Methods: We accept major credit cards and ACH transfers
- Failed Payments: Services may be paused if prepayment is not received. You are responsible for keeping payment information current.
Subscription Terms
- Prepaid Weekly: All services operate on a prepaid weekly basis
- Cancellation: You may cancel at any time with notice. No refunds for prepaid periods already in progress.
- Refunds: Setup fees are non-refundable. Weekly fees are non-refundable once the service week begins, as resources have already been allocated.
60-Day Money-Back Guarantee
We guarantee you will receive qualified leads within 60 days of your website going live. If we do not produce a single lead within this period, you are entitled to a full refund of your weekly fees paid (setup fee excluded). This guarantee demonstrates our confidence in our system - most contractors receive leads well before the 60-day mark.
Tracking Numbers & Call Recording
We assign a dedicated tracking phone number to your territory websites. This number forwards directly to your business phone line. All calls may be recorded for quality assurance purposes. By using our services, you consent to this call recording and agree to inform callers of recording where required by law.
Licensing Requirements
It is your sole responsibility to be properly licensed in your state if your state requires a contractor's license for HVAC work. We do not verify licensing status. Before applying, you must ensure you hold all necessary licenses, certifications, permits, and insurance required to legally operate an HVAC business in your territory. We are not liable for any issues arising from your failure to maintain proper licensing.
Your Responsibilities
As a subscriber, you agree to:
- Provide accurate business and contact information
- Maintain all required licenses, certifications, and insurance for HVAC services in your state
- Respond to leads in a timely and professional manner
- Not resell, transfer, or sublicense your territory rights
- Comply with all applicable federal, state, and local laws and regulations
- Inform callers of call recording where required by applicable law
Intellectual Property
All websites, content, designs, and materials created as part of our services remain the property of Direct HVAC Leads. You receive a license to use these materials for the duration of your subscription. Upon cancellation, this license terminates.
Limitation of Liability
To the maximum extent permitted by law, Direct HVAC Leads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities, arising from your use of our services.
Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid us in the 12 weeks preceding the claim.
No Guarantee of Results
While we use proven strategies to generate leads, we cannot guarantee specific lead volumes, conversion rates, or revenue results. HVAC markets vary by location, season, and competition. Results will vary.
Indemnification
You agree to indemnify and hold harmless Direct HVAC Leads from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.
Termination
We reserve the right to terminate or suspend your account for:
- Violation of these terms
- Non-payment of fees
- Fraudulent or illegal activity
- Conduct that harms our business or reputation
Modifications to Terms
We may modify these terms at any time. We will notify you of significant changes via email or through our website. Continued use of our services after changes constitutes acceptance of the modified terms.
Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Harris County, Texas.
